INEZ — A Magoffin County grandfather who said he tripped over an infield drag at the Martin County Middle School baseball field has filed a lawsuit against school personnel.
Salyersville attorney John C. Collins filed the lawsuit March 21 in Martin Circuit Court for his client Larry Wheeler of Oil Springs.
The lawsuit names Martin County Middle School principal Brent Haney, Martin County School District athletic director Chuck White and “Unknown Employee and/or Agent of Martin County Middle School and/or Martin County Board of Education” as defendants.
According to the complaint, Wheeler tripped and sustained injuries when he attended a game March 29, 2022, at the MCMS baseball field to watch his grandson play.
“As Larry Wheeler was walking on the sidewalk leading to the boys’ bathroom, adjacent to the baseball field, he tripped over the baseball infield drag left on the sidewalk,” the suit states.
Wheeler alleges he sustained severe and disabling physical, mental and emotional injuries, endured severe physical and mental pain, incurred medical and hospital expenses, and will incur the same in the future.
The lawsuit claims the defendants were negligent and asks for punitive and compensatory damages in an unspecified amount.
