WILLIAMSON, W.Va. — Mingo County Circuit Judge Miki Thompson stood firm on her continued denial of bond for the alleged killer of West Virginia State Police Sgt. Corey Maynard.
Timothy Kennedy, 29, of Matewan, through his attorney, Shawn Bayliss, had filed a petition for bond with conditions that would allow him to be on home confinement at his father’s residence. According to the petition, the defendant possesses limited income and little to no financial resources and should not be considered a flight risk since he does not possess a passport and cannot flee the country.
After hearing the request Nov. 14, Thompson denied the petition.
Kennedy is accused of shooting and wounding a male subject June 2 in the Beech Creek area near Matewan. The male managed to escape to a nearby home and request help. Mingo County 911 dispatched multiple officers to the location.
Sgt. Maynard was the first to arrive on the scene. Before Maynard could completely exit his cruiser, Kennedy opened fire on the trooper, striking him three times. Fellow officers were quick to arrive and attempted to administer lifesaving measures to Maynard but could not save his life.
Kennedy fled the scene on foot and became the subject of an all-out search that continued for hours with state troopers from both West Virginia and Kentucky assisting, along with multiple law enforcement from across the region. Kennedy was captured after he stole a vehicle from a residence where he stopped and asked for a cold drink. When apprehended, he was in possession of Maynard’s service revolver.
Kennedy has remained incarcerated without bond since his arrest. In the request for bond and home confinement, his attorney claims he suffers from mental health conditions that include ADHD. The attorney stated those mental conditions can intensify in certain circumstances, such as confinement.
Kennedy has yet to be indicted by the grand jury. However, according to the Mingo County Prosecutor’s office, the case is expected to be presented within the next couple of months.
