TOMAHAWK — Martin County Sheriff John Kirk arrested 42-year-old David Mills of Tomahawk for DUI after he slammed his car head-on into another vehicle Thursday, seriously injuring the other driver.

The collision happened on Route 40 in Tomahawk when Mills crossed over into the westbound lane and struck a vehicle driven by Darrell Mills of Tomahawk.

“Darrell had been to the post office to pick up mail and was heading back to Tomahawk,” Sheriff Kirk said. “He met that boy, and the boy had run off the road and cut back. Darrell was trying to avoid him, so Darrell cut to the left. … He was in Darrell’s lane.”

Both vehicles had major damage.

David Mills was arrested for DUI, third offense, aggravating circumstances.

Darrell Mills was transported to an area hospital and transferred to the UK Medical Center in Lexington.

Sheriff Kirk said David Mills told officers he had dropped something and was reaching into the back seat to get it.

“As soon as I got there, I could tell that he appeared to be impaired,” said Kirk. “Of course, in a situation like that, you have to consider that there could be a head injury or something like that. He refused treatment from the ambulance. We gave him multiple field sobriety tests and he failed every single one of them.”
